Gunjan Chowksey

Gunjan Chowksey is the founding partner of the Firm and heads the litigation team of the Firm. She has laid the foundation of the Firm since its inception. Her excellence in public relations helps the Firm in building long-lasting and fruitful business relations with its clients. She has not only provided the Firm with excellent clientele but has helped the Firm in building an image of professionalism in rendering legal advice to the clients. She has gained her litigation skills from senior counsels like Mr. Ram Jethmalani and her appearances in various courts and forums help the Firm’s constant growth and exposure.

During the course of her legal profession Ms. Chowksey has done a wide array of litigations pertaining to Civil, Criminal, Family, Property, Insurance, Consumer and Company law matters.

The work entailed advising clients on complex issues pertaining to different laws, drafting legal documents required in the case and appearing on behalf of the client before different forums.

DESCRIPTION OF WORK DONE IN THE PAST

Company Matters

She regularly appears before the Company Law Bench of the Delhi High Court. She has represented the Official Liquidator and argued various winding up petitions before Company Law Bench of the Delhi High Court. She has also drafted status reports and legal opinions as amicus curiae in various Company law matters.

Recovery Suits

Contractual obligations between parties often give rise to monetary claims between the parties. The Firm is actively involved in drafting, filing and appearing in such debt recovery matters before various District Courts and the High Court of Delhi and Madhya Pradesh. Ms. Chowksey also has an excellent track record for the recovery suits, complaints filed under Section 138 of the Negotiable Instruments Act, 1881( Cheque Bouncing cases) and filing/defending consumer complaints.

Criminal Matters

Her criminal law experience ranges from drafting and arguing bail applications and other miscellaneous applications in matters pertaining to serious offences like culpable homicide and murder to issues arising out of complaints of cheating, forgery, criminal misrepresentation, criminal defamation, grievous injury and other sections of the Indian Penal Code. She has also argued various quashing petitions, before different High Courts, under section 482 of the Criminal Procedure Code and has obtained favourable orders for her clients. She has also drafted complaints and NCR’s on behalf of the complainants.

Civil Matters

She has appeared before different High Courts for filing and arguing writ petitions, appeals, revision petitions, etc. pertaining to various issues. She has also drafted replies and rejoinders in various civil matters. This includes:

• Suits of specific performance

Insurance/Accidental Claim Matters

She has drafted various Motor Accidents Claim Petitions, Appeals and Counter Appeals for Motor Accident Claims Tribunal (MACT) matters and has been successful in getting good amount of compensation for the victim of the accidents and/or his family members. She has also represented New India Assurance Co. Ltd. and has drafted and argued MACT appeals before High Court of Delhi and National Consumer Disputes Redressal Commission on behalf of the insurance company.

Matrimonial/Family matters

The remarkable feature of her career has been the wide spectrum of matrimonial matters and family law matters done by her from both sides of husband and wife. The first step of the Firm is to conduct the counselling of both the parties to settle the matter out of the Court and in case it fails we proceed with the filing of the cases. She has represented her clients (both husband and wife respectively) in various matters pertaining to:

Ltd. for the purpose of sanctioning the scheme of amalgamation of Sant Rolling Mills Pvt. Ltd. with R.L. Steel Pvt. Ltd.
• She has been associated with various social organizations like Aasra Old age home situated at Bhopal, Gandhi Bhawan, Sakaratmak Soch organization, Nasha  Mukti Kendra etc and was awarded the youngest social worker’s award in the State of Madhya Pradesh.
• She is a regular columnist in the all India magazine named “Madhurima” published by Dainik Bhaskar and helps in spreading legal awareness among the members of the society.
